ClassiDecor Terms and Conditions
Version 3.0 recommended publication text. Prepared 2 October 2026. Before publishing, replace this draft notice with the actual effective date and verify the business identification and contact details.
1 About these terms
These Terms govern use of classidecor.com and, where expressly accepted, ClassiDecor’s interior and exterior design, renovation, furniture, installation and related services. “Client” means the person or entity placing the order. “ClassiDecor”, “we” and “us” mean the service provider identified by its legal name and address in the signed project agreement and invoices. “Project Documents” mean the signed agreement, accepted quotation or bill of quantities (BOQ), approved specifications and drawings, payment schedule, warranty schedule and written change orders.
Browsing the website or submitting an enquiry does not authorise chargeable work. A project starts only after written acceptance, agreement on scope and price, and receipt of the agreed initial payment. Clients must be legally competent to contract and authorised to commission work at the property.
ClassiDecor is a sole proprietorship represented by its sole proprietor Sohom Biswas, having its office at 60, Jaigirghat Road, Khudiram Sarani, P.S. Thakurpukur, Kolkata 700063. It is distinct from Classified Property. Email: hello@classidecor.com. Contract contact: +91 62899 33153; service contact: +91 90515 35566.
2 Acceptance and contract priority
These Terms apply to a work order only when the signed agreement or a clear written acceptance expressly incorporates an identified version. Before signing or paying the execution advance, the Client will receive the exact terms copy and the item-wise Warranty Schedule, with an opportunity to ask questions. A bracketed website address is a reference aid; it does not by itself record informed acceptance of undisclosed restrictions. Silence is not approval.
The agreement will record the live terms URL, version number, effective date and annexure reference. A supplied PDF or printed copy is retained by both parties. Website changes do not retrospectively reduce an accepted warranty or change an existing project; amendments require both parties’ written agreement. A broken link does not cancel an accepted warranty. An approved warranty period written against an item remains binding even if the general page omits that item.
Mandatory law prevails. Subject to it, mutually signed later variations prevail for the matters changed, followed by the project agreement and item-wise Warranty Schedule, the accepted BOQ and specifications, execution drawings, and these Terms. A general exclusion cannot override an expressly promised item-specific warranty. Inconsistencies must be resolved before affected work begins. Browsing or enquiry alone does not form a paid execution contract.
3 Scope and exclusions
We supply only the items and services expressly included in the accepted Project Documents. “Turnkey” does not automatically include every item visible in a reference photograph or 3D render. Appliances, décor, loose furniture, professional statutory approvals, structural engineering, society charges, utility upgrades and specialised services are included only when listed.
For partial work, our responsibility is limited to the agreed scope and its interfaces. We will identify material compatibility or safety concerns that become apparent during our work. Design-only services do not include execution or supervision unless separately ordered. We do not issue statutory architectural or structural certifications unless an appropriately qualified professional has been expressly engaged.
Services may include interior and exterior work, furniture, civil renovation, painting, waterproofing, electrical, plumbing, flooring, facade, doors and windows and epoxy. Execution orders ordinarily include materials and labour, including partial packages; labour-only and supply-only are not standard offerings. Paid 2D and 3D design may be commissioned before execution. Structural work, statutory approval assistance, appliances, society arrangements and utility work may be included only through an express written scope, with qualified professionals and legally required approvals where necessary. No request authorises unapproved structural alteration.
4 Quotations measurements and taxes
Website packages, calculators, photographs and preliminary estimates are indicative. The accepted quotation states its validity, measurement method, item quantities, materials, labour, transport and applicable tax treatment. We will clarify whether each item is fixed-price, measured work or a provisional allowance before acceptance.
Cabinet frontage area, material sheet area and room floor area are different measurements. Charges must use the basis stated in the quotation. Final quantities for measured work will be recorded and shared with the Client. Changes to a fixed-price item require an approved change order.
GST or other legally applicable charges will be identified in the quotation and invoiced as required by law. An agreed fixed price will not increase merely because our procurement costs increase. New work, changed quantities, approved specification changes and legally required tax changes will be documented separately.
Quotations remain valid for 60 days from issue unless an earlier replacement is expressly accepted. Execution quotations are fixed-price for the stated quantities and specifications; site measurements are confirmed before acceptance. Later scope or specification changes require a priced written variation. Transport, unloading, stair carrying, debris removal, ordinary cleaning and professional deep cleaning must each be identified as included, excluded or separately priced in the quotation. No inclusion or additional charge is inferred from silence. ClassiDecor is currently not GST registered and will not collect an amount represented as GST while unregistered. Following lawful registration, applicable tax treatment and any effect on an existing agreed price must be documented according to law and the signed price terms.
5 Design and material approval
The design fee, deliverables, first-draft date, included revision rounds and any credit against execution must be stated in writing. Design development begins after the required information, site measurements and agreed payment are available. A revision round means one consolidated set of Client comments on the submitted design; additional rounds require an agreed fee.
Manufacturing and installation follow approved execution drawings, specifications and selected samples. 3D images communicate appearance; lighting, screens, natural materials and site conditions can affect the result. Any material dimensional or functional departure requires approval. Corrections to our own design or measurement errors are not chargeable Client revisions.
After approval, changes may affect cost and completion. We will provide their effect in writing before proceeding. We will not substitute a specified brand, material grade or finish without written approval. If an item is unavailable, the Client may approve an alternative or agree to omit the affected item with an appropriate adjustment.
5.1 Standard design fees. Fees for 2D layout and 3D views are INR 15,000 for 1BHK, INR 25,000 for 2BHK and INR 35,000 for 3BHK up to 1,400 square feet carpet area. A 3BHK above that limit requires a specific written quotation. Villa, independent house and bungalow design fees are determined after project review. Execution drawings, BOQ, walkthroughs and editable source files are not included in this design package unless expressly listed. Design fees are paid in advance against the accepted design order.
5.2 Design programme. The first design submission is expected approximately ten days after written approval of the design order, receipt of the design advance, required information and measurements; the order must state whether these are working or calendar days. Three consolidated revision rounds are included. Additional scope, redesign after final approval and extra rounds require a separately accepted fee and revised programme. Our own errors are corrected without consuming Client revision rounds.
5.3 Execution credit and cancellation. If ClassiDecor executes the agreed project, 50 percent of the paid design fee is credited once against the project bill, without cash redemption or double credit. The quotation identifies how the fee and credit interact with the execution total. After the agreed design deliverables are completed and supplied, the design fee is not refunded merely because the Client does not proceed with execution. Before full delivery, settlement reflects services actually delivered and documented commitments; remedies for non-delivery, defective design or breach remain available. Full payment grants use of the supplied design for the specific property, including execution by another contractor. ClassiDecor is not responsible for another contractor’s workmanship or unauthorised changes, but remains responsible for its own agreed design duties.
5.4 Approval records. Minor daily updates may be approved by the designated Client through email or WhatsApp. Final layouts, material specifications and changes affecting price or completion require explicit written approval identifying the exact drawing or document version. Each party nominates one authorised representative in the Work Order; conflicting family instructions are referred to the Client representative before affected work continues.
6 Client authority access and approvals
The Client must provide accurate property information, relevant existing drawings and known defects, and obtain owner, landlord or association consent where required. The Project Documents will allocate responsibility for municipal, fire, utility and other permissions. Unless expressly included, the Client obtains property-owner and building-management permissions; ClassiDecor supplies reasonable information about its proposed scope to support them.
All work remains subject to the rules of the authority governing the site, including applicable building and fire requirements and lawful association rules. Association consent does not replace a statutory approval. Structural changes, alteration of exits or common services, façade work, changes of use and work on heritage property require specific assessment before execution. We may refuse or pause unsafe or unauthorised work. We remain responsible for compliance obligations imposed on us by law.
The Client provides agreed working access, water, safe power, storage and a clear work area, subject to the agreed allocation of cost. Working hours, lift access, deposits and protection of common areas must be recorded before mobilisation. ClassiDecor is responsible for penalties or damage attributable to its own breach; the Client is responsible for charges attributable to its own breach.
7 Site condition and safety
Before work, both parties should record visible existing damage and retained fittings. The Client should remove valuables and identify items that must be protected. ClassiDecor will take reasonable precautions to protect retained property and common areas and manage its personnel safely.
Concealed leakage, damp, pests, unsafe wiring, weak plaster or structural defects may become visible during work. We will notify the Client, explain the effect and seek approval for additional rectification. An urgent safety issue may require immediate protective action and a pause. Any emergency expense claimed must be reasonable and supported by records.
We are not responsible for pre-existing defects we did not cause, but remain responsible for damage caused or worsened by our work or negligence. Debris removal, final cleaning and disposal arrangements must be stated in the scope and carried out lawfully. No blocking of fire exits or unsafe alteration will be undertaken.
8 Payments and invoices
The signed payment schedule states the amount due at each defined milestone and its due date. Work progress will be assessed against the accepted scope or agreed BOQ values, rather than an unexplained percentage. ClassiDecor will provide an invoice or payment request and supporting progress information.
Payments must be made to the account stated on an official invoice or otherwise confirmed in writing by ClassiDecor. Payments to workers or vendors are not payments to ClassiDecor unless expressly authorised and acknowledged. We will issue receipts. Any applicable statutory deduction must be accompanied by the required documentation.
If a payment is disputed, the Client must identify the disputed item and reason in writing and pay the undisputed amount by its due date. Both parties will seek prompt resolution. Late interest or collection charges apply only if expressly agreed and lawful; there is no automatic undisclosed penalty.
8.1 Standard execution instalments. Unless both parties expressly sign a different project schedule: 50 percent of the accepted execution value is payable before commencement; 15 percent when 50 percent of the agreed work is completed; 15 percent when 75 percent is completed; 10 percent upon completion; and the remaining 10 percent within two calendar months of the recorded project handover date. Approved variations are billed under their own agreed schedule. Payment dates for milestone requests are recorded in the Work Order; no separate universal seven-day invoice deadline is created here. The agreed BOQ weighting or another written progress method determines completion, not elapsed time or money spent alone. Each request identifies achieved work and available evidence. Design advance and its execution credit are separately reconciled to avoid charging them twice.
9 Extra work and client changes
An extra-work order must identify the changed scope, specification, quantity or measurement basis, price, applicable taxes, payment and time impact, and receive written approval from both authorised representatives before work begins. A verbal instruction to a worker does not amend the contract.
Client-supplied products and independently appointed contractors must be disclosed for coordination. ClassiDecor remains responsible for its own installation quality where installation is included. Product defects in Client-supplied items and damage caused by an independent contractor are allocated to the party responsible. Any additional coordination, rework or storage charge requires prior written agreement.
10 Start date completion and delay
The Project Documents will state the start conditions and completion period, including whether days are calendar or working days. Mobilisation requires the agreed payment, safe site access, required permissions and the approvals needed for that stage. A marketing statement is not a project-specific completion guarantee unless expressly incorporated.
A delay caused by Client changes, withheld approvals, unavailable access, another contractor or an event genuinely beyond reasonable control may justify a proportionate extension. ClassiDecor will promptly explain the cause, mitigation and revised programme. Ordinary poor planning, avoidable supplier delays or staff shortages do not automatically excuse performance.
Any agreed delay compensation must be recorded in the signed agreement. No automatic compensation amount is created by these Terms; statutory remedies remain available. If an exceptional interruption continues for more than 30 days, either party may request a revised programme or termination with settlement under Clause 12.
11 Suspension and termination for breach
For overdue undisputed payment or another material breach, the affected party will give written details and at least seven calendar days to remedy it before suspending the affected work or terminating, unless immediate suspension is reasonably necessary for safety or legal compliance. ClassiDecor will secure unfinished work and provide a restart plan when the issue is resolved.
The Client may likewise require correction of material defective work or other breach and terminate if it is not remedied within the notice period, allowing a reasonable agreed correction period where necessary. Suspension does not authorise seizure of possessions, removal of installed paid-for work or denial of lawful property access. Additional restart or storage costs must be reasonably incurred, documented and agreed, without double recovery.
12 Cancellation and refund settlement
Cancellation must be communicated in writing. Settlement will include design services actually delivered at the agreed fee, accepted completed work and reasonably evidenced non-cancellable procurement or custom manufacturing commitments. Avoidable future costs, unused refundable advances and supplier refunds must be credited. No blanket forfeiture of every payment applies.
A separately agreed design fee may be retained once the specified design deliverables have been completed and supplied. A non-refundable label does not exclude remedies for non-delivery, defective service or breach. Before ordering custom items, we will identify the commitment and obtain approval. Custom products cannot ordinarily be returned merely for a change of preference after approved manufacture; defective or non-conforming items remain subject to correction and applicable remedies.
The signed Work Order will record the itemised settlement and refund deadlines. ClassiDecor will promptly provide available supporting records and refund the undisputed balance within the agreed period and without unreasonable delay. If dates are absent, the parties will promptly record a reasonable settlement timetable; mandatory shorter deadlines remain applicable. Pending supplier recoveries will be identified with expected dates and refunded promptly after receipt. These periods do not postpone a shorter statutory deadline. Where ClassiDecor cancels without Client breach, it will refund unearned payments and provide paid-for deliverables; other lawful remedies remain unaffected.
13 Inspection snagging and handover
We will arrange a joint inspection and written handover record listing completed items, outstanding work, defects, manuals and warranty details. The parties will agree a reasonable rectification date for each snag. Minor snags do not remove our duty to correct them; substantial incomplete or defective work must not be described as fully complete.
The final payment and any retention are governed by the signed agreement. Any disputed amount should reasonably relate to the disputed work, with undisputed dues paid as agreed. Occupation, silence or payment does not automatically waive defects or statutory rights. Keys entrusted for work must be accounted for and returned at handover or earlier termination, subject to the Client’s lawful access rights.
The final ten-percent instalment falls due within two calendar months of recorded project handover under the standard schedule. Joint inspection lists each outstanding item and its agreed correction date. Handover is not deemed to waive latent defects. Any item handed over earlier has its own warranty commencement record.
14 Item wise warranties and service procedure
14.1 Warranty Schedule. Before order acceptance, both parties will agree a schedule identifying each covered BOQ item, its material and brand or model, warranty provider, separate product and workmanship coverage, exact duration, start event, remedy and specific exclusions. Durations written in the signed schedule are the applicable commercial warranty promises; they are not replaced by competitors’ advertised durations. No uniform lifetime warranty is offered. An item without an additional commercial warranty remains subject to applicable rights concerning defective goods, deficient services and misdescription.
14.2 Commencement. Unless an item-specific written schedule states otherwise, ClassiDecor’s workmanship warranty starts on the recorded actual completion and handover of that item or work package. A completed item cannot lose coverage merely because another package is unfinished or the final handover signature is delayed. Manufacturer coverage starts under its own disclosed policy, which may use the invoice, delivery or installation date. The handover record must state the relevant dates. An agreed retention or instalment not yet due does not suspend warranty. Payment default is handled under the payment and breach clauses; it does not automatically void all warranties or statutory remedies.
14.3 Covered workmanship. Where promised for the stated period, coverage includes defects attributable to ClassiDecor’s manufacture or installation under normal intended use: for example, faulty assembly, bonding, fixing, alignment, grouting, connections or application within the contracted scope. Product coverage is separate. We will not describe a material as branded, BWP, termite-proof, waterproof or of a particular grade without supporting specifications. A promise of termite or water resistance applies only as specifically documented and cannot be used to imply protection against every infestation or source of water.
14.4 Item-specific scope. Furniture schedules must distinguish carcass, shutter, laminate or finish, hardware and accessories. Ceiling coverage must identify boards, framework, joint treatment and included finish. Painting must identify base preparation, specified coating system and covered failure. Electrical and plumbing schedules must distinguish supplied fittings from installation and the exact circuits, joints or lines worked on. Glass, mirrors, stone and tiles require a distinction between breakage or natural characteristics and damage or failure attributable to delivery, manufacture or installation. Normal natural variation disclosed and accepted is not itself a defect; damage caused by negligent handling or incorrect fixing is not excluded merely because an item is fragile.
14.5 Waterproofing. A waterproofing warranty is offered only against a signed schedule specifying the treated area, substrate, system, preparation, outlets and joints included, water or curing test where applicable, covered failure, period and maintenance requirements. Leakage from an untreated terrace, adjoining flat, external wall, unrelated pipe or structural movement is excluded only to the extent it caused the failure and was outside the agreed scope. A generic damp exclusion does not excuse failure of the waterproofing treatment we expressly undertook or recommended negligently.
14.6 Manufacturer products. Hardware, appliances, lights, sanitary fittings and other branded products carry the disclosed manufacturer warranty where applicable. ClassiDecor will supply purchase or warranty records reasonably available, explain registration requirements and assist with valid claims for products it supplies. Unless separately promised, it does not extend the manufacturer’s duration. It remains responsible for its own selection, description and installation and any non-excludable seller or service-provider liability. A manufacturer’s refusal is not automatically a complete defence to our own breach.
14.7 Client duties. Use products for the agreed residential or commercial purpose, follow written care and load instructions, keep surfaces reasonably dry and ventilated, report leakage or pests and take reasonable steps to prevent further damage. Do not place additional loads on ceilings, modify circuits, dismantle units or use damaging cleaners contrary to provided instructions. Inform ClassiDecor before non-urgent third-party alterations to a covered component. Allow reasonable agreed access for inspection and rectification and retain available invoices and handover records. Failure to produce a warranty card is not automatic rejection if the purchase and coverage can be verified from other reliable records.
14.8 Exclusions with cause. Additional commercial coverage does not normally cover ordinary wear, cosmetic scratches arising during use, misuse, overload, impact, fire, flood, external leakage, pests or an unrelated structural defect, to the extent that cause produced the claimed failure and the accepted item-specific promise did not cover it. An exclusion applies to the affected defect or component, not automatically to the entire project. The cause will be explained with available evidence. Failure to follow undisclosed care instructions is not a basis for rejection. No exclusion removes responsibility for our defective workmanship, misrepresentation or negligence where liability cannot lawfully be excluded.
14.9 Claim notification. Report a discovered defect promptly to hello@classidecor.com or +91 90515 35566, with project details, affected item, discovery date and photographs where reasonably possible. Phone reports will be logged and confirmed in writing. There is no automatic seven-day forfeiture rule. An unreasonable reporting delay may affect responsibility for demonstrably avoidable additional damage; it does not erase every claim. The commercial coverage period and the legal limitation period for proceedings are different matters. A valid claim notified within coverage does not cease merely because inspection or repair occurs after expiry.
14.10 Inspection and decision. We will log the claim, request necessary information and agree an inspection date with the Client within a reasonable time. Assessment may require site access, technical tests and manufacturer input. We will communicate the expected assessment and next-update dates; if additional time is needed, we will explain the reason and revised dates. Urgent risks of injury or substantial damage receive priority. After assessment we will explain whether the claim is accepted, partly accepted or rejected and why, identifying the relevant agreed term. Our assessment is not final against the Client’s right to challenge it, obtain independent advice or approach a competent forum. There is no fixed three-day or seven-day assessment promise; this does not authorise indefinite delay.
14.11 Repair and costs. For a covered ClassiDecor defect, reasonable inspection, labour, replacement material and necessary removal and reinstatement of our affected work are included. We will communicate a repair plan and date; unavailable parts require an explained revised plan, not indefinite postponement. Repair is ordinarily attempted first if technically suitable; replacement, a proportionate agreed refund or another effective solution will be considered where repair is unsuitable or repeatedly fails, without limiting statutory relief. A replacement should have comparable function, quality and agreed appearance; material differences require Client approval. Exact batch shades may be unavailable and will be disclosed. Excluded repairs or additional work require an approved estimate before charging. Manufacturer call-out and other product claim costs follow the disclosed manufacturer terms, but our own faulty installation rectification remains our responsibility.
14.12 Repair coverage and emergency action. A repair or replacement normally continues the unexpired original commercial warranty unless a written additional period is granted or mandatory law requires otherwise. A repair remains subject to obligations of reasonable skill and quality; this clause does not erase liability for a defective repair. If immediate action is necessary to prevent injury or substantial damage, the Client may obtain reasonable emergency assistance, documenting the condition and notifying us as soon as practicable. Necessary emergency assistance or an unrelated third-party repair does not automatically void every warranty; coverage for damage caused by that intervention is assessed separately.
14.13 Continuity. The warranty applies to the original contracting Client and permitted users at the specified site for the agreed use. Relocation, resale or transfer does not automatically create additional commercial coverage; any transfer arrangement must be recorded. Statutory rights of persons entitled under law remain unaffected. Warranty, payment, refund, confidentiality and dispute obligations intended to continue survive completion or termination to the extent applicable.
14.14 Standard workmanship periods. Unless an item-specific variation is expressly agreed before ordering, ClassiDecor covers its own manufacturing and installation defects for three years for kitchen, wardrobe and furniture assembly, laminate or finish application and wall-panel installation, false-ceiling framework/fixing/joint treatment, electrical wiring/connections and plumbing pipe/joint installation. Painting surface preparation and coating application and countertop installation carry one year. These are ClassiDecor commercial commitments, not periods mandated by law or common to all companies. Waterproofing duration is agreed for the particular treatment system and site in the signed schedule before work. Other categories, including facade, epoxy and doors/windows, require specific scheduled periods; no period is implied from another category.
14.15 Material warranty versus workmanship. Plywood or another material carrying a manufacturer warranty of ten, fifteen, thirty years or another duration receives that coverage only where the precise purchased product, proof, registration, intended use and failure meet the manufacturer’s written conditions. No brand-wide duration is promised. Such coverage does not extend automatically to the whole furniture, adhesive, finish, hardware, assembly or labour, and does not extend ClassiDecor’s workmanship period. Covered manufacturer remedies, any proportional settlement and labour, transport or dismantling exclusions are disclosed before acceptance. ClassiDecor assists claims for products it supplies and retains responsibility for its own breach.
14.16 Work-specific coverage. Furniture coverage includes faulty assembly, bonding, fixing and alignment caused by our work; ordinary use marks, disclosed natural variation and user-caused damage are excluded only where causally relevant. Painting covers failure attributable to agreed surface preparation or application in treated areas, not unrelated external leakage; exterior exposure requirements are documented. Ceiling claims distinguish faulty suspension, fixing and joints from unrelated structural movement or added loads. Electrical and plumbing cover defective connections and installations in the circuits and lines contracted, not every existing circuit or pipe in the premises. Hardware product defects follow OEM coverage, while our faulty fitting remains workmanship. Waterproofing claims assess the signed system, treated area and interfaces. Glass/stone fragility does not excuse damage caused by our handling. Inspection identifies the cause; chargeable non-covered work requires prior written approval.
15 Personnel and responsibility
ClassiDecor may appoint qualified vendors and subcontractors for its scope and remains accountable to the Client for the contractual work it undertakes. A vendor’s involvement does not by itself transfer all responsibility to the Client. The Client should route instructions through the designated project representative.
16 Designs photographs and personal information
Unless otherwise agreed, ClassiDecor retains intellectual property in its original designs and grants the Client, after payment of the applicable design fee, a licence to use the paid-for design for the contracted property. This licence does not transfer rights in third-party images or products. Editable source files are included only when expressly listed. Necessary records may be shared with professional advisers or authorities for the project or a dispute.
We may take necessary progress photographs for measurement, quality control and contract records. Public marketing use of photographs or videos of the Client’s property requires separate express permission. Consent to a project is not consent to publish faces, addresses, documents or personal belongings. Personal information must be handled under a separately published Privacy Policy and applicable law. Enquiry details may be used to respond to that enquiry; unrelated promotional contact requires the consent applicable to it.
17 Website information and use
Use the website lawfully and do not disrupt it, attempt unauthorised access or misuse its content. Website images may include reference concepts or renders and must not be assumed to depict completed ClassiDecor projects unless described as such. Third-party links have their own terms. We do not guarantee uninterrupted website availability.
An enquiry or indicative calculator result is not a confirmed order. If online ordering or payment is introduced, the applicable order disclosures, cancellation terms and grievance arrangements must be provided before purchase. Nothing here excuses a misleading advertisement or false description.
18 Complaints responsibility and jurisdiction
Send complaints to hello@classidecor.com or contact +91 90515 35566. Warranty complaints follow Clause 14. Other complaints will receive the same acknowledgement and assessment targets. Both parties will cooperate with reasonable inspection, preserve relevant records and consider settlement. Discussion normally aims at resolution within 30 days; it is not a mandatory barrier to urgent relief or proceedings and does not extend legal limitation.
Each party is responsible for loss attributable to its breach, negligence or unlawful conduct, subject to applicable law and reasonable mitigation. There is no blanket exclusion of direct damage, injury, fraud, deliberate wrongdoing, misleading descriptions, defective services or non-excludable product liability. A subcontractor appointment does not remove ClassiDecor’s accountability for its agreed scope.
Indian law governs. For ordinary civil contractual disputes, the parties select courts at Kolkata only to the extent those courts otherwise possess jurisdiction under applicable law. If Kolkata lacks jurisdiction, the competent forum under law applies. This clause does not override mandatory rules concerning subject matter, property, statutory tribunals or consumer territorial jurisdiction. It does not require every complaint concerning work elsewhere in West Bengal to be filed in Kolkata.
A person qualifying as a consumer retains all applicable remedies and competent Consumer Commission jurisdiction, including residence or place of personally working for gain where the governing statute permits. Commercial clients’ eligibility as consumers depends on the statutory definition and actual purpose of the transaction; a label in the contract does not decide it. No waiver of consumer remedies is required. No mandatory arbitration is incorporated by these website Terms; any separately negotiated arbitration agreement remains subject to law and does not bar available statutory consumer remedies.
19 General and contact
If a provision is unenforceable, the remaining provisions continue so far as lawful. Waivers and amendments must be explicit and recorded in writing. Notices and approvals may be exchanged through the designated email or WhatsApp contacts in the Project Documents, with clear identification of the document or version approved. Formal termination or dispute notices should also be sent to the contractual notice address. Acknowledgement of receipt is distinct from agreement.
